Ruth Moore is an experienced business litigation attorney whose practice focuses on appeals and critical legal issues.  She brings strong analytical and legal writing skills to all of her cases, whether representing clients on appeal or co-counseling with trial attorneys on critical motions, framing and preserving issues, and posturing cases for appeal.   


Ruth has litigated a wide variety of business disputes over the course of her career, including breach of contract, business tort, intellectual property, First Amendment, California anti-SLAPP, and regulatory matters. She also briefs and consults on legal issues in criminal cases in collaboration with trial counsel. 


Before partnering with Marie Williams (now retired), Ruth practiced law at an AmLaw 100 firm, an energy law firm, an entertainment litigation boutique, and a solo practice. Ruth additionally serves as an arbitrator for the Financial Industry Regulatory Authority. 

Experience

Notable Appeals

  • Successfully represented cattle feedlot on appeal in obtaining reversal of judgment under wildlife code.
  • Successfully represented a foreclosure law firm on appeal against the Attorney General's attempt to revive Colorado Consumer Protection Act claims that were rejected at trial. 
  • Successfully represented a gas gathering and processing company both in an appeal regarding contract interpretation and in a subsequent appeal concerning claim preclusion.
  • Successfully represented a criminal defendant on appeal to uphold a county court’s dismissal of charges based on police officers’ failure to collect exculpatory evidence.
  • Successfully challenged the validity of a municipal ordinance based on state-local governmental conflicts and statutory preemption, representing the client both in the district court and on appeal.
  • Successfully represented an internet service provider in asserting statutory immunity and federal preemption against state-law claims seeking to impose liability for third-party content, including opposing certiorari in the United States Supreme Court. 
  • Successfully represented investors on appeal against a mutual fund’s assertions that the investors’ fraudulent inducement claims constituted derivative claims, rather than direct claims, and were arbitrable under the Convention on the Recognition and Enforcement of Foreign Arbitral Awards. 
  • In two different court-appointed representations, successfully represented applicants for disability benefits in appealing denials by the Social Security Administration. 


Trial-Level Experience

Ruth also draws upon her extensive litigation experience at the trial level. Before focusing her practice on appeals and briefing of critical issues, Ruth handled the gamut of trial-level litigation with a full range of motions, pleadings, discovery, investigations, negotiations, and settlements. Among other experience, Ruth: 

  • Litigated a wide variety of contract and other disputes on behalf of a public utility company, a pipeline company, and energy companies. 
  • Represented entertainment clients (television, motion picture, videogame) in numerous contract and intellectual property disputes in state and federal courts and in arbitration.
  • Defended clients accused of misleadingly advertising a dietary supplement, ultimately negotiating settlements with the Federal Trade Commission and a consumer class for substantially less than the amounts claimed.
  • Represented a television studio in litigating a royalties dispute regarding a popular children’s television program, achieving a complete victory for the client at trial.
  • Worked with criminal defense counsel in defending an employee accused of business crimes, including obtaining a dismissal of a significant count of the indictment based on the prosecutors’ failure to disclose exculpatory information to the California grand jury. 
  • Successfully represented victims of a natural gas explosion in obtaining recovery for personal injuries and business losses. 
  • Defended a motion picture studio against consumer class actions based on alleged false advertising. 
  • Defended a grocery store chain against consumer claims alleging failure to post food warnings and miscalculation of refunds.
